NOTICE OF SPECIAL TOWN MEETING

AUGUST 3, 2020

 

A special town meeting of the electors and citizens qualified to vote in town meetings of the Town of Beacon Falls, Connecticut, will be held at Beacon Hose Company #1, 35 North Main Street in Beacon Falls, Connecticut, on Monday, August 3, 2020 at 7:00 p.m. for the following purposes: 

1.         To consider and act upon a resolution,

            (a)        to appropriate $5,000,000 for costs in connection with various road and related storm water drainage and sanitary sewer improvements.  The project is contemplated to include improvements to such roads listed in the pavement management study dated March 27, 2019 and prepared for the Town by StreetScan, as the same may be updated from time-to-time (the “Pavement Management Study”), as are determined by the Board of Selectmen following receipt of recommendations from the project engineers, including, but not limited to, reconstruction, reclaiming and repaving of roadway systems, replacement of catch basin tops, installation of new catch basins, curbing, sidewalks, guide rails and driveway aprons, inspection and cleaning, repair or replacement of storm water drainage pipes and sanitary sewer lines, and landscaping and restoration; and related easement acquisitions, work, improvements, equipment and appurtenances.  The appropriation may be spent for design, acquisition, installation and construction, appurtenances, equipment, materials, engineering and inspection fees and costs, landscaping restoration, legal fees, net temporary interest and other financing costs, and other costs related to the project.  The Board of Selectmen shall be authorized determine the scope and particulars of the project and may reduce or modify the project scope; and the entire appropriation may be expended on the project as so reduced or modified; and

(b)        to authorize the issue bonds or notes of the Town in an amount not to exceed $5,000,000 to finance the appropriation for the project; to provide that the amount of bonds or notes authorized shall be reduced by the amount of grants received for the project and not separately appropriated to pay additional project costs; and to authorize the issue temporary notes of the Town in an amount not to exceed $5,000,000 in anticipation of such bonds or notes and the receipt of project grants; and to authorize a majority of the Selectmen and the Treasurer of the Town to determine the amounts, dates, interest rates, maturities, redemption provisions, form and other details of the bonds or notes; and to perform all other acts which are necessary or appropriate to issue the bonds or notes. 

Copies of the Pavement Management Study are available for inspection in the Office of the Town Clerk, Town Hall, 10 Maple Avenue, Beacon Falls, Connecticut.   

2.         To consider and act upon a resolution,

            (a)        to appropriate $1,000,000 for costs in connection with upgrades to the Town’s Wastewater Treatment Plant, and related work, improvements, equipment, and appurtenances, as to be determined by the Water Pollution Control Authority following receipt of recommendations from the project engineers.  The project is contemplated to include, but not be limited to, electrical upgrades and acquisition and installation of a new generator.  The appropriation may be spent for design, installation and construction costs, appurtenances, equipment, materials, inspection costs, engineering fees, legal fees, net temporary interest and other financing costs, and other expenses related to the project.  The Water Pollution Control Authority shall be authorized to reduce or modify the scope of the project, and the entire appropriation may be spent on the project as so reduced or modified;

(b)        to authorize the issue bonds, notes or other obligations of the Town in an amount not to exceed $1,000,000 to finance the appropriation for the project; to provide that the amount of bonds, notes or other obligations authorized shall be reduced by the amount of grants received for the project and not separately appropriated to pay additional project costs; and to authorize the issue temporary notes or interim funding obligations of the Town in an amount not to exceed $1,000,000 in anticipation of such bonds, notes or obligations; and

(c)        to authorize the Water Pollution Control Authority to complete the sanitary sewer system project, to approve design and other expenditures incurred for the sanitary sewer system project, and to contract with engineers, contractors and others on behalf of the Town for said sanitary sewer system project. 

Each of the resolutions to be presented under items 1 through 2, inclusive, above shall also: 

(a)        take action to allow temporary advances of available funds and to declare the official intent of the Town that it reasonably expects to reimburse any such advances from the proceeds of borrowings in an aggregate principal amount not in excess of the amount of borrowing authorized for the project; authorize the authorize a majority of the Selectmen and the Treasurer of the Town to amend such declaration of official intent as they deem necessary or advisable and to bind the Town pursuant to such representations and covenants as they deem necessary or advisable in order to maintain the continued exemption from federal income taxation of interest on the bonds or notes authorized to finance the appropriation, if issued on a tax-exempt basis, including covenants to pay rebates of investment earnings to the United States in future years, and to make representations and enter into written agreements for the benefit of holders of the bonds or notes to provide secondary market disclosure information, which agreements may include such terms as they deem advisable or appropriate in order to comply with applicable laws or rules pertaining to the sale or purchase of such bonds or notes; and

 (b)       authorize the Board of Selectmen, the First Selectman, the Treasurer and other proper officers and officials of the Town to take all other action which is necessary or desirable to complete the project and to issue borrowings and obtain grants to finance the appropriation.

3. To consider and act upon the following budget transfers and additional appropriations for the 2019-2020 Fiscal Year:

  1. Police Overtime: $36,008.82
    • $21,775 from 10.90.53.1685 “Part Time Patrol” to 10.90.53.1049 “Wages – Overtime”
    • $14,233.86 from 10.90.83.1170 “Contingency” to 10.90.53.1049 “Wages – Overtime”
  2. 2018 Tornado Debris Clean-Up (Supreme Industries): $58,339 from “Undesignated Fund Balance” to 45.90.90.2197, “Project/Debris Removal and Clean up 5-15 Storm”.
  3. COVID-19 Additional Appropriations: $30,000 from “Undesignated Fund Balance” to Non-Recurring Capital Projects Fund 45.90.57.0019 “COVID-19”, for a total appropriation of $49,999 for COVID related expenses.
